I paid for an iphone xs max, she took my money and did not ship the item and no has deactivated the account. What do I do??!

The website just emailed me and said I need to file a police report and deal with it myself. They let her do this on their site and then banned her from said site, it is their responsibility to give/get my money back, not mine
